When a buyer enters into a commission with
the artist, they agree by these terms.
• The artist still retains the image
copyright and may post it anywhere at their discretion. As such,
the buyer agrees not to redistribute copies of the image for public
display/sale/trade/profit in any form.
This copyright also prohibits the reproduction of the image for
display on the Internet without express written permission from
the artist. If you do any of the above without the express written
permission of the artist, you will find yourself coming under copyright
infringement.
• The
artist reserves the right to cancel the commission at any time;
If the cancelation is due to circumstances beyond the buyer's control,
then a refund will be given for any work not completed.
• The
artist retains the right to refuse doing any further work on a commission
where the artwork has already undergone three revisions.
In this case the artist may choose to:
a) Offer a partial refund for work done thus
far and terminate the commission.
b) Offer the buyer a chance to pay extra
to have the commission revised further.
• It
is the buyer’s responsibility to communicate all the necessary
information to the artist so that they may produce the best possible
image. The buyer must ensure that they supply all relevant information
before work commences on the art. This
can come in written or pictorial form. Should the buyer fail to
communicate their concept properly, then they will be held responsible
for any dissatisfactory result.
• The artist can not
be held responsible for loss or damage of items in the post that do
not have insurance cover. If you would like an item insured and tracked,
you must notify the artist and pay the additional charge for the service.
• Should a buyer cancel
a commission, the artist retains the right to complete and sell the
artwork to a third party at their leisure.
• Should the buyer cancel
a commission at any stage, then the artist retains the right to issue
a partial refund dependant on how much work has already been done
on the commission. If a deposit was paid in advance to reserve a commission
opening, then this deposit will be forfeited.
• The artist retains the
right to add to/alter the agreement where they see fit, bearing in
mind the interests of all parties involved.
